Terms of Sales

1 Application
The general conditions of sale (hereinafter "GTC") apply to all legal acts concluded on the Association Notre Pays online Association Notre Pays . These online businesses are managed by Association Notre Pays in Sion. The GTC also apply to all legal acts concluded within the framework of the trader (hereinafter “seller”) of the Association Notre Pays .
Third party suppliers (hereafter “sellers”) offer products and services on their behalf and sell them directly to customers from Association Notre Pays online Association Notre Pays .
l ' Association Notre Pays reserves the right to modify these T & Association Notre Pays at any time. The version of the GTC in force at the time of the order is decisive and cannot be changed unilaterally for this order. The customer's conditions which are in contradiction with or which derogate from these GTC are not recognized.
Deliveries are only made to addresses in Switzerland.
Offer is valid as long as the product can be found in online stores using the search function and while stocks last.
For all orders of products requiring the minimum age of 18 years (in particular alcohol and tobacco), the customer confirms by his order that he complies with these legal provisions. L ' Association Notre Pays reserves the right to refuse orders exceeding the usual quantities for a household or following problems encountered with said customer.

2 Information
2.1 Product and price
Images of products appearing in advertising, flyers, online stores, etc. are used for illustration and are non-binding. All sales prices published in online commerce are the final prices, which include all taxes (including VAT), any advance recycling taxes (TAR), packaging costs, excluding delivery costs. L ' Association Notre Pays and the sellers reserve the right to modify the prices of the products and services offered at any time. The price indicated in the online store at the time of the order is decisive for the conclusion of the contract. All sellers authorized to sell their products and services on online sales sites have their head office in Switzerland.

2.2 Availability and delivery time
L ' Association Notre Pays attaches great importance to displaying availability and delivery times as accurately as possible in its online stores but, due to production or delivery problems, delivery delays may however occur at sellers. This is the reason why all the information relating to availability and delivery time is given as an indication and can be modified at any time.

3 Conclusion of the contract
Products and prices posted to Association Notre Pays online Association Notre Pays are considered offers. However, these offers are always subject to the resolutive condition of an impossibility of delivery or an incorrect price indication.
For products and services offered by a seller, the contract is concluded directly between the trader and the customer at the time of the order in online shops. the Association Notre Pays only serves as a mediator. The Association Notre Pays acts in this case as an intermediary and as a service provider for the seller, but does not itself become a contracting party. The customer must pay in Swiss francs.
During the purchase, the customer can see on the online shops as well as on the invoice who the supplier / contracting party is (therefore the trader / seller).
When ordering online, receipt of the order is confirmed to the customer by means of an order confirmation automatically generated by e-mail. Receipt of the automatically generated order confirmation does not contain confirmation that the product can actually be delivered. It only informs the customer that the online store has received his order and that the contract has therefore been concluded with the trader / seller, provided that the latter can be delivered and that the price indicated is correct.

4 Delivery time
When acknowledging receipt of the order, a provisional delivery date is indicated to the customer. In the event of late delivery on the part of the seller, the customer is entitled (except for special orders) to withdraw from the contract from the 30th calendar day following the delivery period initially announced.
In this case, the seller reimburses the customer for the amounts already paid. There is no possibility of making a claim to the Association Notre Pays or the vendor.

5 Delivery
For Association Notre Pays products and services, all delivery and collection options listed in the online store under “Delivery and collection” are available to the customer.
The products and services that the customer buys from a vendor can only be sent to the customer in general by Swiss Post or by an approved carrier at the Association Notre Pays .
The delivery address must be in Switzerland and be easily accessible by carrier. If this is not the case, any additional costs are the responsibility of the customer.

6 Customer's duty of control
It is also the customer's responsibility to check the products delivered immediately after receipt as to their accuracy, completeness and functionality. Any damage on delivery must be specified on the delivery note to the transport company only.
Any errors or damage must be reported to Association Notre Pays (even if it concerns a product or a seller's service) immediately after their discovery or at the latest within 5 calendar days following the receipt of products.
The customer can do so from the online commerce form or by e-mail to sav@notre-pays.ch. The customer is not authorized to use a damaged product. He must keep it in its original packaging and follow the instructions for the return process indicated under the “Return and Guarantee” section of his customer account.

7 Guarantee
7.1 General provisions
Only the seller takes charge of the guarantee of absence of defects and of proper functioning of the product ordered according to the product ordered and the guarantee of the manufacturer or the seller. Compensation following a product defect or malfunction can be done as follows at the seller's discretion:
° free repair
° partial or total replacement by a used / repaired product of the same value
° replacement by a new product by the seller or his supplier
° a credit at the daily price or
° a discount.
Wear parts, especially batteries, batteries, power cords, light bulbs as well as software problems are excluded from the seller's warranty. For the rest, the exclusions of liability apply in accordance with article 8. In the event of a dispute, the manufacturer's warranty applies.

7.2 Additional provisions for used goods
Further provisions apply for products designated as "demo model", "refurbished", "test device", "repair" or "show model" in the online store. These may have slight visible defects or be reconditioned products. These apparent defects are excluded from the guarantee and are mentioned in the details of the articles. These products have a warranty period of one year from their delivery.
The customer is aware of the fact that he is buying a used electronic product which could contain possible personal data of the former owner / user and that, in this context, the trader declines all responsibility.

8 Liability and exclusion of liability
Liability falls under the provisions defined by law. The responsibility of Association Notre Pays or the seller is however never engaged for slight negligence, direct, indirect and consequential damages, loss of earnings, unrealized savings, as well as damages resulting from late delivery. , and any actions or omissions of auxiliaries of the Association Notre Pays or of a seller, whether within the framework of a contract or outside of any contract.
In addition, the Association Notre Pays or the seller Association Notre Pays no liability for the following causes:
° improper storage, positioning or use, contrary to the contract or illegal of the product,
° use of incompatible accessories or spare parts (e.g. power supply),
° absence of maintenance and / or inappropriate modification or repair of the product by the customer or a third party,
° in the event of force majeure, in particular damage caused by the elements, humidity, falls, blows, etc., which cannot be attributed to CACL and the authorities.

9 payment
l ' Association Notre Pays directly sends payment requests for products and services purchased from CACL online stores to the customer. With the conclusion of the contract, the seller assigns the entire claim, resulting from the purchase contract between him and the customer, to Association Notre Pays (assignment). The customer acknowledges this assignment and is required to address all payments only to Association Notre Pays . Payments must be made in Swiss francs.

The customer can use the payment methods offered in online shops under “Payment methods”.
The costs in force are indicated in the section “Payment methods” and are detailed in the ordering process.
In the event of payment by credit card or other instant payment means, the debit takes place at the time of the order.
In all cases, delivery takes place only after receipt of payment.

10 Modification or cancellation of the order
Orders oblige the customer to pay and receive the products and services. l ' Association Notre Pays or the seller may, at its sole discretion, accept subsequent modifications or cancellations of orders and invoice compensation up to 20% of the amount of the canceled order, but at least CHF 50.–, as well as the possible loss of value (since the order) of the canceled products.
If a (partial) impossibility of delivery (resolving condition) occurs after the order or the conclusion of the contract in accordance with article 3, the customer is immediately informed by e-mail. If the order has already been paid, the amount will be refunded. If no payment has been made, the customer is released from his payment obligation. Any other right related to a delay or an impossibility of delivery is excluded.

11 Return of goods delivered without defect
Under the conditions listed on Return conditions, the seller alone grants the right to return its products within a maximum period of 10 calendar days from the date of dispatch.

The customer must also register the return of the products himself in his customer account under "Return and warranty" on online sales sites, and return the goods to the address indicated. The products must be sent with all accessories in the original packaging and packaged appropriately. Damaged products are not taken back and are invoiced to the customer in full.
If the customer uses his right of return in accordance with the aforementioned return conditions, the seller will reimburse him for the entire purchase price, with the exception of any costs which may be borne by the customer.

12 Repair out of warranty
The costs of a repair out of warranty, in accordance with article 7, are the responsibility of the customer. l ' Association Notre Pays or the seller reserve the right to charge the customer for the costs of checking and returning products with non-visible defects or damage not covered by the manufacturer's warranty, in accordance with article 7.

13 Data protection
The Data Protection Declaration applies to the processing of personal data on the Association Notre Pays online sales sites.
the Association Notre Pays will not provide information about these customers or orders to third parties except to the vendor from whom the order was made for delivery.

The responsibility of Association Notre Pays can in no case be engaged if the seller transmits these data to third parties.

14 Partial invalidity
If certain provisions of these GTC should prove to be null or void, the validity of the other provisions of the contract is not modified in any way.

15 Place of jurisdiction and applicable law
All legal relationships between Association Notre Pays or a seller and the customer are subject to Swiss substantive law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Only the following jurisdictions are applicable:
° For all disputes arising from sales contracts with Association Notre Pays as contracting party:
° For legal actions brought by consumers, the forum is Sion. In all other cases, the exclusive forum is Sion.
° For all disputes arising from sales contracts with a seller as a contracting party:
° For legal actions brought by consumers, the forum is the seat of the seller. In all other cases, the exclusive place of jurisdiction is the seller's seat.
° For all disputes arising from sales contracts with a seller as a contracting party:
° For legal actions brought by consumers, the forum is the registered office of the trader or that of the customer's domicile.
